Job Summary

The Legal Manager and Compliance Officer - LATAM (GG), provides legal support to all functional areas of Global Generics' operations in Latin America (LATAM). As Compliance Officer - LATAM (GG), he/she provides direction and oversight of the global compliance program ("Global Compliance Program") at the regional level for the Global Generics line of business and is also responsible for managing and developing the Compliance Program and Global Business Ethics at the regional level.

Job Responsibilities

  • The Legal Manager and Compliance Officer – LATAM (GG), provides intellectual property support and general legal support to all functional areas of Global Generics operations in Latin America (LATAM).
  • As Compliance Officer – LATAM (GG), he is responsible for supporting, managing and developing the global compliance program (“Global Compliance Program”) at the regional level for the Global Generics line of business. The Legal Manager and Compliance Officer – LATAM (GG), provides intellectual property support and general legal support to all functional areas of Global Generics operations in Latin America (LATAM).

As Legal Manager:

  • Agreements - Negotiate, draft and review a wide range of contracts for multiple areas of the company, including manufacturing, supply, licensing, marketing, purchasing, service, sales and confidentiality agreements.
  • IP - Manage and advise on Intellectual Property throughout the region the intangible assets of the company.
  • Patents: Carry out patent evaluations to avoid the infringement of third-party rights. Provide advice on the patent landscape in Latin America related to the launch of new products. Carry out searches of the state of the art and nullity analysis. Response to ex officio actions of the Mexican Patent Office. Management of patent litigation.
  • Brands: It is responsible for the registration, protection and maintenance of the trademark portfolio in Latin America. Provides legal advice to protect trademarks from infringement and dilution. He is responsible for coordinating and supervising lawyers and external legal firms in matters of intellectual property.
  • Legal Advice: Provides advice on corporate issues, advice regarding advertising materials, data privacy, corporate and administrative matters, is responsible for monitoring changes in local legislation and informing business areas to defend and protect the rights of the company and mitigate risks.
  • Regulatory: Provides legal support to the regulatory team in relation to the requirements of the Health Authority.
  • Litigation: It is responsible for handling all types of litigation, administrative procedures and developing litigation strategies in Intellectual Property matters.
  • Corporate – Supports the Legal Director in corporate matters such as drafting of shareholders' meetings, granting and revocation of powers, management of procedures before notaries.
  • Labor: Supports the legal team in labor matters from time to time as requested. 

As Compliance Officer – LATAM (Global Generics):

  • Ethic Liaison: Serves as liaison with the LATAM Business Ethics and Compliance Officer (“LATAM BECO”) on compliance issues, activities and programs in LATAM. Collaborate with compliance officers in LATAM and other regions
  • Develop and review LATAM compliance policies aligned with global ethics and procedures.Monitors LATAM compliance to detect and prevent violations of laws or policies.
  • Compliance Awareness and Training: Responsible for communicating the importance of the Global Compliance Program to the executive management and employees of Apotex LATAM (Global Generics). As well
  • As developing and coordinating compliance education and training programs for all Global Generics LATAM employees, focusing on the commitment to comply with all laws, rules, regulations, policies and ethical requirements.
  • Oversees anonymous reports and investigations of non-compliance within LATAM, coordinating with legal and external resources.Compliance Committee: Works with the LATAM Business Ethics and Compliance Officer to jointly establish the LATAM Compliance and Ethics Committee, and co-chair and manage all its meetings and affairs.

Job Requirements

Educational requirements or preferences:

  • Degree in Law
  • Specialist in Intellectual Property. 
  • English - advanced required.

Work experience

  • Minimum experience of 7 years in intellectual property issues - desirable in the Pharmaceutical Industry o Consumer Goods Industry
  • Extensive experience in civil, commercial, labor and administrative legislation.
  • Experience in coordination and management of external law firms and lawyers.
  • Office, IUS LEGAL, Legisystem, Ark Patent Intelligence, Thomson Reuters Innovation.
  • Knowledge of NOM-059
  • Quickly understand legal and business issues and provide personalized legal advice in plain language.
  • Provide timely advice in a fast-paced business environment.
  • Assume leadership and manage strategic legal projects, in a cross-functional team environment.
